Terms of service

These terms cover Monolith services, workshops, free beta downloads, and digital Agent Systems. A signed proposal, statement of work, checkout screen, or product license may add terms for a specific engagement or product. If those documents conflict with this page, the more specific written agreement controls.

Services, scope, and quotes

Published service prices are starting ranges. Final scope, timeline, deliverables, review points, and price are confirmed in writing before work starts. Work outside the agreed scope is quoted and approved before it begins.

Service payment

Fixed-scope projects normally invoice a deposit before kickoff and the balance at written milestones. Consulting and workshops invoice as stated in the proposal. Retainers normally invoice monthly in advance. A project may pause when an invoice is overdue.

Workshops and scheduled sessions

Unless a proposal says otherwise, reschedule or cancel at least 24 hours before a session at no charge. A session cancelled inside 24 hours may bill at half the scheduled rate. A missed session without notice may bill in full.

Digital products and free betas

A digital product is licensed, not sold. The license included with the download states who may use it, whether internal modification is allowed, and which forms of sharing, resale, sublicensing, redistribution, marketplace upload, or competing-product use are prohibited. Free beta access does not transfer ownership of the Product source.

Product pages identify release status, included files, compatibility claims, support, updates, and known prerequisites. Beta products may change and may contain defects. A platform badge is not a promise that every account, tenant, model, tool, or future platform version will behave the same.

Paid Agent Systems are finished digital downloads delivered as the files identified on the product page. No consulting, managed service, custom implementation, or hosted AI service is included with a product purchase. Installation support is limited to the support period stated on the product page.

Delivery, checkout, and final-sale policy

Free downloads are delivered directly from the site. When a paid Agent System is marked Available, checkout, tax calculation, payment, receipt, and secure file delivery are hosted by Creem as merchant of record. The hosted checkout displays the final price and applicable terms before purchase.

Paid digital Agent Systems are delivered immediately, and all sales are final. Monolith does not offer voluntary refunds for change of mind, failure to use the Product, dissatisfaction with disclosed features, buyer-environment incompatibility that was accurately disclosed, or changes made by an AI model or third-party platform after purchase.

This final-sale policy does not limit rights that cannot legally be waived or Creem's obligations as merchant of record. For a duplicate or unauthorized charge, inaccessible or corrupt delivery, or files materially different from the product page, email hello@monolithdesign.agencywith the product name and order number. Monolith will first correct the delivery or provide conforming replacement files. Creem may process a remedy when required by applicable law or its merchant obligations. Do not send payment-card data, passwords, or API keys.

Ownership

After final payment, a client owns the custom final deliverables identified as client-owned in the written project agreement. Monolith retains its pre-existing materials, reusable tools, templates, Agent Systems, generalized methods, know-how, and any material expressly licensed rather than transferred. Product source files remain subject to the license included with that Product.

Monolith may reference non-confidential custom work as portfolio proof unless an NDA or project agreement says otherwise.

Third-party platforms and costs

Models, APIs, hosting, analytics, email, automation platforms, plugins, and other third-party services are governed by their own terms. Unless included in writing, the customer is responsible for those accounts, permissions, data choices, subscriptions, usage charges, and provider changes.

Responsible AI use

AI output can be incomplete or wrong. You remain responsible for human review and for decisions involving publication, spending, deletion, deployment, credentials, privacy, security, law, finance, health, employment, or other consequential matters. Monolith products do not replace a qualified legal, financial, medical, security, or accessibility professional.

Prohibited conduct

Do not use the site, downloads, or services to violate law, infringe rights, bypass security, distribute malware, expose credentials, abuse third-party services, or copy and redistribute a Product outside its license. Access may be suspended for fraud, abuse, infringement, or a material license breach.

No guaranteed business result

Monolith commits to the written scope and acceptance criteria, not a guaranteed ranking, revenue, audience size, platform approval, model response, or other result controlled by markets or third parties.
